Terms of Service

1. Who we are and definitions

1.1 Citebility is a service provided by Go-Virtual (a sole proprietorship, registered with the Dutch Chamber of Commerce under number 77601262, VAT ID NL003213469B81), also trading under the name Artificial Studio. In these terms this business is referred to as "Citebility".

2.1 These Terms apply to all use of the Service and to every agreement between Citebility and the Customer.

2.2 The Customer's own terms and conditions are rejected.

2.3 Citebility may amend these Terms. The version applicable to any use of the Service is the version in force at the time of that use or of the order.

3. Business use only

3.1 The Service is intended exclusively for business use. By using the Service, the Customer represents and warrants that it acts in the exercise of a profession or business and is not a consumer.

3.2 As the Service is not offered to consumers, consumer law — including the right of withdrawal — does not apply.

3.3 Citebility may ask the Customer for business details, including a Chamber of Commerce number, and may refuse or terminate access to the Service if the Customer does not provide these or if Citebility reasonably suspects that the Customer is not acting in a business capacity.

4. The Service and permitted use

4.1 The free scan is intended for owners and marketers to gain insight into the visibility of their own website. The Customer represents that it is authorised to have the submitted website analysed.

4.2 The Service is provided on a best-efforts basis and "as is". Citebility gives no guarantee on ranking, visibility, mention in AI answers or commercial outcomes, and does not provide SEO, legal, financial or strategic advice.

4.3 Abuse, automated use and scraping are not permitted. Citebility applies rate limits per email address and IP address and may restrict or block use in case of (suspected) abuse.

4.4 The Customer indemnifies Citebility against third-party claims arising from the unauthorised analysis of a website, from data supplied by the Customer, or from the Customer's use of the Report.

5. AI output and fallibility

5.1 Citebility analyses website visibility by querying public AI models (including ChatGPT/OpenAI, Gemini/Google, Claude/Anthropic, Perplexity and Mistral). These models are probabilistic and may produce inaccurate, outdated or fabricated information — a phenomenon known in the literature as "hallucination". AI model responses may also differ between sessions or when re-tested.

5.2 Citebility mitigates this by querying each prompt multiple times and reporting only consensus answers. This does not fully eliminate variability. Citations, attributions and factual statements in the Report reflect what AI models produced at the moment of scanning, not verified facts about the Customer's website or market.

5.3 Commercial, strategic or other decisions are not made by the Customer solely on the basis of a Citebility report. The Report is a directional instrument, not a verdict or guarantee.

5.4 The AI systems and brand names mentioned belong to their respective owners. Citebility is not affiliated with or endorsed by these parties.

6. Prices, payment and delivery

6.1 The scan is free. The Report is paid; the applicable price is stated on the website at the time of ordering. Prices are in euros.

6.2 Payment is processed via Stripe and is made in advance. The Report is made available electronically once payment has been confirmed.

6.3 This is a one-time purchase; there is no recurring subscription.

7. Refunds

7.1 A purchase is final. A delivered Report is not refunded.

7.2 If a Report cannot be generated, or cannot be generated in full, due to a technical failure on Citebility's side, Citebility will re-run the scan or otherwise make the Report available. This counts as repair or re-delivery of the Service, not as a refund in money. If repair or re-delivery is not reasonably possible, Citebility may decide to refund the amount paid.

7.3 Dissatisfaction with the content, scores or recommendations of a correctly delivered Report does not give rise to a right to a refund; this follows from the directional and AI-based nature of the Service as described in article 5.

8. Liability

8.1 To the extent permitted by law, Citebility is not liable for indirect damages, including consequential damages, lost profit, missed savings, reputational damage and loss of data.

8.2 For free use of the Service, Citebility's total liability is limited to € 100. For a paid Report, total liability is limited to the amount the Customer paid to Citebility for that Report.

8.3 Liability of Citebility arises only after the Customer has given Citebility written notice of default and a reasonable period to remedy the failure, to the extent remedy is possible.

8.4 The limitations in this article do not apply in the event of intent or deliberate recklessness on the part of Citebility.

9. Intellectual property

9.1 All intellectual property rights in the Service, the software, the analysis method, the scoring model and the layout of the Report belong to Citebility or its licensors.

9.2 The Customer may use the Report for its own internal and marketing purposes.

9.3 It is not permitted to systematically copy, publicly benchmark, sell, reverse-engineer the Service, the analysis method, the prompts, the scoring model or the output, or to use them to develop a competing service.

10. Privacy

10.1 When the Service is used, Citebility processes personal data, including the Customer's email address and IP address and the submitted website URL. How Citebility handles this is set out in the privacy policy.

10.2 To carry out a scan, data about the submitted website is processed by external AI providers (including OpenAI, Google, Anthropic, Perplexity and Mistral). The privacy policy describes this in more detail.

11. Governing law, complaints and contact

11.1 These Terms and every agreement are governed by Dutch law.

11.2 Disputes are submitted to the competent court in the Netherlands.
